Scenario: During the Vietnam War, a “draft” was put in place that selected young men born on certain dates and placed them in the armed services. The process proceeded via lottery: Dates like “Sept. 14” were placed in capsules, one for each of the 365 days of the year, and the capsules were then drawn randomly from a container. In the 1970 draft, Sept. 14 was the first date drawn, meaning that all young men born on Sept. 14 were eligible for the very first round of the draft, and so on. After the results of the 1970 draft were analyzed, many statisticians and politicians asserted that the process had not been random at all, and certain men had a higher chance of being drafted than others. This case is famous, making it to the pages of international newspapers and the U.S. Supreme Court.

In the SPSS data file in Blackboard, you will find the original 1970 draft data with two variables. Column 1 contains the consecutive day of the year (1 = Jan. 1; 2 = Jan. 2; and so on). Column 2 contains the draft rank (1 = first date drawn; 2 = second date drawn; and so on). So, in the first row of the data set, Day 1 (Jan. 1) had a draft rank of 305. The lower the draft rank, the sooner and more likely a man was to be drafted. So a higher rank (like 305, for example) was preferable to those who did not want to be drafted right away.

If the process had been statistically random, there would be no correlation between the day of the year you were born and the rank that was assigned to you (r = 0). Any type of significant correlation would mean that there was something relating the variables beyond mere random error, or chance.

Students will analyze a case study and then write a consultancy report applying concepts and ideas learned throughout the course. Students are expected to effectively use a wide range of the course readings in completing the paper, which means the course readings are used to support ideas and reasoning rather than as stand-alone statements.

The purpose of this project is two-fold. First, students will learn how to write a consultancy report and second, students will link the concepts of Dunn as a social architect, change agent, and individual to Dunn as a relationship builder. Think of a relationship builder as a leader who aligns people to his or her vision.

Students will act as a consultant hired to help Dunn address his role as a relationship builder. Interface the plan you created in Assignment #1- The Role of a Leader, with a plan for Dunn’s need to address the potential threats to workforce harmony. Emphasize his role as leader and what he can do to build his relationship with his employees so that he empowers his managers and workforce to implement his vision for the company. Dunn’s Emporium Experiences Growth
Dunn’s Emporium is going gangbusters and George who owns the deli next door is getting ready to retire. Dunn is in the process of acquiring The Deli. Although most of the local long-time employees at Dunn’s and The Deli have been on board with the merger some employees have never been happy.
The Deli people did not trust the new ice cream manager because of his age. Fresh out of culinary school, John Levitz, at age 22 became the ice cream manager. Ice cream was one of The Deli’s biggest iconic menu offerings. The ice cream is homemade and The Deli offers a special flavor each week. John has big ideas in expanding the ice cream business by having classes and opportunities for customers to make their own flavors. He is passionate about his job but sometimes rubs the older employees the wrong way. He can be arrogant about his skill. He thinks he is being confident. The chef at The Deli is jealous of the newcomer because he has wanted to change the menu for some time. He thinks that George’s retirement will be the demise of his dreams because the new General Manager that is working with George is not on board with innovation. His attitude is “if isn’t broken don’t fix it.” However, the new General Manager tells Dunn and George that he is happy with making changes.
Dunn’s sporting goods has had a change of employment as well and a new group of South American immigrants hascome to work at the Emporium. Dunn is impressed with the wonderful skills of the workers as they display outstanding repair work and the group’s work ethic as seen by their willingness to work long hours during the ski season is impressive. Dunn’s long term employees agree that the new employees are a good addition to the staff but find working with the group hard because they are not able to understand Spanish and sometimes it creates problems in communicating order information. Also, the group tends to stick together. They even eat lunch together despite attempts by the other employees to get them to join in with the rest of the group. There seems to be a growing frustration on the part of the original group. What neither the original employees nor Dunn know is that because of the language barrier the new South American employees are apprehensive about being included in the group because they cannot speak English well and do not know how to break the language barrier. What the original employees do not know as well is that Esteban Enrique has asked to be promoted to the vacancy as head of the second shift in the repair shop. Dunn has concerns that if Estaban is promoted that it might be hard to keep the cohesiveness of the group. He is especially concerned because his nephew who works the evening shift during the off season would like the job. In short, Dunn has to revisit his organizational structure, culture and vision to make the changes necessary to prevent future problems with the business. Further, he hasn’t told anyone but he wants to put in new software to monitor the staff hours, payroll, and business sales. It will make information gathering much easier but will require some staff scheduling changes and authority delegation.
Using you first organizational plan, culture, vision and mission, discuss all the changes that Dunn might consider in keeping his business expansion going strong. Also consider all the leadership challenges that Dunn himself must address in the areas of personal skills, leading change, diversity, knowledge management, office politics and empowerment.

In week 4, students will submit to the Assignment Folder a brief one page paper that identifies the unique ethical issue, the ethical dilemma and the traditional theories that will be used to suggest potential resolution of the dilemmas.

Review the fact pattern provided below. At this time, Mr. Kant stands convicted of either petit larceny or shoplifting, as dictated by your state statutes, and your office has been hired to handle the appeal. Based on your lessons and reading material regarding legal analysis and writing, legal research, legal citation and appellate procedure, prepare the appellate brief based on relevant statutory and case law from your state of residence. Proper format is outlined in Stat sky on pages 600-602, and detailed in your state court rules, form-books, etc.

Thoroughly research the issues involved and address the statute/s from your state under which Mr. Kant would be charged and convicted. Locate at least one binding opinion upon which to base your arguments and apply the opinion in a thorough and concise manner. You should also apply any relevant secondary authority that might be used in support of your arguments. In completing this assignment, please focus on demonstrating your research, analysis, citation and writing skills over format of the brief.

Bear in mind that you do not have access to the trial court record for this assignment, which would not be the case in an actual law office setting. Therefore, you may embellish the facts as necessary to fully develop your arguments. Use care, however, not to allow those embellishments to change the issues involved.

FACTS: Sam Kant, stands convicted of shoplifting/petit larceny (as dictated by your state statutes) from Bilmart, a national department store. At his wife’s request, Mr. Kant went to Bil mart on Wednesday, ______, 20___, and purchased a case of six 4 oz. cans of Hoover’s Baked Beans with Bacon. Upon returning home, his wife chastised him for once again failing to purchase what she had requested. Apparently, Mrs. Kant can’t stand the taste of Hoover’s Beans, but is very fond of the Handel brand, and was planning to serve them to her book club when she hosted them for lunch the following afternoon. Mrs. Kant ordered her husband to return to Bil mart to exchange the Hoover’s beans for Handel Beans.

Upon arrival at the store early the next morning, Mr. Kant found that the line for customer service was extremely long due to Bilmart’s annual sponsorship of a major community food drive. In an effort to save time, and thinking the line might be shorter upon his return, Mr. Kant placed the case of Hoover’s beans into a shopping cart, made his way through the store to the bean shelf, and then added the Handell’s beans to the cart. However, upon his return, the line had not diminished and it was obvious that Sam would be waiting a considerable amount of time to formalize the exchange. Fearing the wrath of his wife should he not return in time for lunch, Sam placed the case of Hoover’s beans inside a cart filled with what appeared to be merchandise returns in need of re-stocking. With the desired Handell’s beans in the shopping cart, Mr. Kant then proceeded to the store’s exit. As he neared the doors, Mr. Kant was approached and detained by store security, who witnessed Sam’s actions, and police were called to the store. Apparently, the cart into which Sam had placed the Hoover’s Beans did not contain returned items to be shelved, but rather, donations to the Bilmart Community Food Drive. Officers Kopp and Slickman questioned Mr. Kant and then cited him for Shoplifting.

Discuss U.S. Labor Legislation.

Create a timeline of all the significant labors legislation passed in the 20th century using Word’s Table feature. Next to the name of each law, place a column with the year it was passed, and then another column, in your own words, provide a description of what the law covered. The periods before the 20th century were marked by abuse of employees by employers. There were no laws put in place to protect the rights of their employees and to prevention harassment by their employers and to promote fair treatment in a workplace. This greatly led to conflicts between the employees and the employers. However this was corrected by the introduction of various labor laws in the in the country which helped to improve the relationship of the employer and the employees (Bonasia, 2000). These laws are going to be described in the table below.

The Davis Bacon Act 1931 This is a law that was passed when the united states was facing the great depression and it required that the companies in the united states were to make existing wages for construction projects that were federal assisted. The aim of the act was to eliminate firms and workers that did not belong to a union from government projects and this would increase the cost of taxpayers. It received a lot of support from many unions. It was amended in 1935 by The national Labor relations Act/The Wagner Act after the setting of minimum wages. The reasons for failure were: it only aimed at protecting firms and workers who ere unionized. Secondly, the law aimed at raising wages and this affected the citizens by increasing taxes. Finally the unions that supported this did it on the basis of very bias reasons such the aim of kicking out the blacks from employment (Whitfield, 2004).
The national Labor relations Act/The Wagner Act 1935 This act was invented as a response to the much labor violence that had been experienced in the 1930s such as strikes. This act gave the right of unions which were to play the role of negotiating and bargaining on behalf of the employees to the employers. No law was put in place to amend this act but amendments have been made on the same law from time to time. It is amended from time to time to make it better and more favorable.
Fair Labor Standards Act 1938 This law played a role in establishing the required number of working hours in a week, making it compulsory for employers to pay overtime fee, set a minimum wage and set rules to regulate child labor. This law has not also been amended by another law but certain parts of the law have been amended such as the equal pay act. This is to make the law more favorable and cover emerging grievances.
