Comparative Constitutional Law
Part one
Constitution Rights: Due Process
Each country has different legal systems implemented to drive and guide the operations of the country. There are different legal systems namely: common law and civil law.
Common law and civil law
Common law is a legal system that is majorly derived by judges on the basis of their decisions in the court (Palmirani, 2012). Common law is different from civil law in matters of characteristics. Common law has no written constitution nor codified laws. Secondly, in common law, everything is permitted since the law does not prohibit them. Additionally, every person is subjected to same sets of law despite of ranks or levels of position (Palmirani, 2012).
On the other hand, civil law is a legal system that presides over disputes among individuals and it takes a parallel hand to common law. Unlike common law, civil law works on a written constitution and codified laws. Secondly, a legislative enactment binds every factor. Additionally, in civil law, individuals have less freedom (Palmirani, 2012).
