Ending the FED
In May 2007, Orc Industries Corp. fired Bilbo accusing him of dishonesty and coming to work drunk. There was no evidence of Bilbo coming to work drunk except for an empty bottle of Shire Whiskey was found buried in a cabinet in his office.
Can Bilbo successfully sue for wrongful dismissal? Why or why not? If he can successfully sue for wrongful dismissal, what would be reasonable notice in his situation? What factors would the courts consider in awarding a period of notice to Bilbo if he were to be successful? What would the likely outcome be?
YOUR ASSIGNMENT
When doing the assignment, envision that you are a young lawyer and the fact scenario represents a case that has come to your office. A senior lawyer has asked you to write a memorandum of law. In that memorandum of law you are expected to be able to do the following:
Identify the relevant parties or players in the fact scenario.
Identify the relevant legal areas, principles and concepts that apply to the fact scenario.
Explain why and how the relevant legal areas, principles and concepts apply to the fact scenario.
Provide a likely outcome of how this fact scenario would be resolved by a Court or Judge. State your reasons why by applying the relevant legal areas, principles and concepts. For example, which party should be successful, the plaintiff (the party suing), or the defendant (the party defending or responding to the plaintiff’s law suit?
DO NOT REGURGATATE THE FACTS.

You are required to submit a paper between 500-750 words. This paper should be double-spaced, 12-pt font (TNR or Arial preferred).

Interviewing the Interviewer, Report (Individual)

Write a report of between 1,400 and 1,800 words about your interview. You should use complete sentences, complete paragraphs, a few quotations from the interviewer and some reported speech.
Here is the recommended outline for your report:
Introduction. Include a fictitious name for your interviewer (see Helpful Hints below), his/her job title and the type of organisation or company that he/she works for. Explain briefly what you wanted to find out from the interview and why you selected this person. Include when and where the interview took place and how long it lasted.
Findings. Do not list your interview questions and then give the response. Select several themes from what you wanted to find out and discuss the interviewer’s responses OR select several themes from the interviewers’ responses and discuss them. Sub-headings are acceptable in this report.
Recommendations. You may make a few recommendations about how the interviewer could improve his/her interview practice; how you as the interviewer of the interviewer would do it differently the next time you conduct an interview; or what you learned from doing the interview. You also could include how the interviewing assisted you with your own reflections on your personal image.
Conclusion. Write a brief summary of the main points of your report.
Appendix. Include a copy of your final Interview Schedule which you used during the interview. Do not include any interview notes or transcriptions in your report.
Helpful Hints: Be sure to ensure that your interviewer remains anonymous. You may make up a fictitious name for him or her such as Mrs Wong when that is not her real name or Mr A. You should also give a fictitious name to the organisation or company where your interviewer works. For example, you interview the Textile Support Supervisor at Mercantile Outfitters. It should be OK to keep the job title but the name of the company should be changed to ABC Company or Jeans R Us as a made up name.
We will review reported speech (also known as indirect speech) in class. Make sure that you have both quotations and reported speech in your report.
You probably will not be able to include every type of finding and/or recommendation in your report because of the word limit. You will need to decide on the most important points that you want to make in your well-organised report.
