National Security

Has the term as defined in 2002 grown to encompass more?

In 2002, homeland security was defined as “a concerted national effort to prevent terrorist attacks within the United States, reduce America’s vulnerability to terrorism, and minimize the damage and recover from attacks that do occur” (Office of Homeland Security, 2002). Back then, this definition largely encompassed preventing terrorist activities. This was because the country had experienced one of the worst terrorist attacks in its history and the effects of this had not left the people’s minds. Terrorist activities were defined as “any premeditated, unlawful act dangerous to human life or public welfare that is intended to intimidate or coerce civilian populations or governments” (Office of Homeland Security, 2002).

In 2007, the definition given for homeland security remained the same but it entailed so much more. The country had witnessed hurricane Katrina, the worst national disaster in its history. Threats broadened in meaning to include those that are caused naturally and those that occur because of human actions. Threats also include infectious diseases, floods, earthquakes, industrial hazards and infrastructure failures. The government identified seventeen critical infrastructure and key resources. Some of these include agriculture and food, chemical, banking and finance, drinking water and water treatment services, energy, information technology and telecommunications among others (Homeland Security Council, 2007).

Should the definition be changed? If so, what elements should be included in the new definition?

The definition of homeland security should change to reflect all the changes that have been made. Terrorism is a premeditated and unlawful act directed towards people. Natural disasters and system failures on the other hand are not premeditated and they cannot be defined in legal terms. This definition is limiting and one would think that the duties of the homeland security are only concerned with terrorist activities and other activities related to terrorism. Someone who needed help in case of disasters such as floods would not know where to go or who to ask for help. The aim is to make America safer, stronger and more prepared (Homeland Security Council, 2007). The definition of homeland security should be changed to include other threats other than terrorism.

Several cases involving gang violence, school shooting and other foul crimes have been reported. In some of these cases, such as school shooting, the suspect committed the crime alone. These cases are considered criminal activities rather than acts of terrorism. Taking into account the definition of terrorism, the acts were actually premeditated, unlawful and dangerous. In addition to this, they were directed towards a person or a group of persons. This therefore proves that such cases are acts of terrorism but in some instances, they are not regarded as such. A new definition of terrorism should broaden the definition of terrorism and put in the natural and human caused hazards. This might add to the duties of those who are concerned with homeland security but the definition will be all-inclusive and disasters will be handled in a more effective manner.

Do you agree with Dr. Bellavita’s assessment of seven defensible definitions for homeland security?

Bellavita defines homeland security in seven ways. His definitions include terrorism, man-made and natural hazards, catastrophes, jurisdictional hazards, meta-hazards and national security (Bellavita, 2008). Since the original definition has already included the national effort, it is not necessary to distinguish between the definition at the state and the local level. This can be included as part of the various duties to be carried out by different agencies in case disasters occurs. Therefore defining homeland security as being about jurisdictional hazards is not necessary. He goes on to add drug-resistant diseases, pandemics and cyber space in his list of threats while this has already been included under infrastructure and key resources. He posits that if homeland security is about everything, then it is about nothing. I agree with this view because not everything can be about homeland security. If this was the case, people would find the need to blame homeland security for every little thing that happens and they would not see the need to do anything on their own. The current definition, though limiting, ensures that everybody has a role to play to ensure that he or she lives in a safe and secure society and nation.

Early Age European/American Schooling Systems Vs Japanese Schooling Systems

There are many differences between European/American and Japanese schooling. First, the age of admission of children in Japanese schools usually is six years whereas for the European/American schools it ranges from four to six years. The number of school days that children attend in Japan is generally 175 schooldays unlike their counterparts who have fewer school days that are usually 160 and more holidays. In the Japanese setting, children have short holidays that are usually five weeks long unlike their counterparts who have a three months summer holiday . The time spent by European and American children on holiday, is spent on classes by Japanese children thus, they have more time to learn. Children in the American and European schools can choose what language they want to learn, but in the Japanese system, English is compulsory.

In Japan, preschools start their classes at 8:30am to 3:20 in the afternoon. Moreover, they have after school activities that include singing hymns, playing, painting, coloring, and doing homework. Otherwise, in the American and European setting, children start their classes at 9:00 in the morning and end at 3:00 in the afternoon. However, there are no after school activities. Japanese children have fixed classes allocated to them so they stay in one classroom for all their subjects. In addition, American and European children have different classrooms for different subjects; usually, they are the ones who change the classes instead of the teachers. In American and European schooling system, the number of children in each class varies from fifteen to twenty children unlike their counterparts who have thirty-forty depending on the size of the school.

In Japanese schools, children are supposed to wear uniforms and keep their hairstyle short and neat. Nevertheless, in the American and European setting, children are given freedom to wear any outfits, keep any hairstyle and makeup is part of their outfits. The difference in behavior is still a major difference in both the societies because in the Japanese situation, children are selfish, smart, competitive, respectful and bow to their teachers as they walk into the classes, unlike there counterparts who have bad attitude towards themselves and disrespectful to their teachers.

American and European schools have only four subjects to learn from mainly English, Social science, and Mathematics, unlike their counterparts who have more subjects such as social studies, arithmetic, science, life and environmental studies, music, arts and handicrafts, homemaking, and physical education. Moreover, kids in Japan have two to three hours of homework everyday compared to maybe one hour for American and European. Children Books, notebooks, jackets, bags, and P.E kits are kept in classrooms in Japanese schools whereas in American and European schools, they have lockers in the hallway, where children leave their possessions. In between classes, children pass by their lockers and take their next lesson books while going to their respective classes.

In Japanese schools, the management has put in place time in the morning for the children to have morning exercises and prayers in order to boost physical and religious beliefs on the curriculum. In the end, Japanese schools have a broad curriculum hence their children get more quality education early hence they perform better than European and American schools.

I           Kathleen McDonald O’Malley was born in 1956 in Drexel Hill, Pennsylvania. She is a federal judge for the United States Court of Appeals for the Federal Circuit appointed by President Barrack Obama on 10 March 2010. She was nominated by President Obama on the same date to fill the vacated seat. Her predecessor was Alvin Schall. She was confirmed by the US Senate on December 23, 2010. She graduated with a Bachelors degree from Kenyon College in 1979 and later in 1982 received a Juris Doctor degree from the Case Western Reserve University School of Law. She has served as a law clerk at Honorable Nathaniel Jones’s, U.S. Court of Appeals office, Sixth Circuit, from 1982 to 1983. O’Malley has also practiced law privately with the Porter, Wright, Morris and Arthur firm and in Cleveland at Jones Day firm. This was from 1983 to 1991. She was the Chief Counsel of the Attorney Generals office in the state of Ohio from 1991 to 1993. She later became the Chief of staff and the first assistant from 1993 to 1994. O’Malley was later appointed a federal Judge for the United States District Court for the Northern District of Ohio, where she has been serving from 1994 to 2010 before her appointment by President Obama. She had been recommended by Ohio Senators John Glenn and Howard Metzenbaum and was appointed for the post by President Bill Clinton on September 20, 1994. Her then predecessor was John Potter.

It deals with the development, support and sale of computers and products and services related to computers. The company has a staff base of about ninety six thousand people all around the world. The company is the third largest manufacturer of computers in the world. The company has annual revenue of about $53 billion. Its operating income is about two billion and its net income is about one and a half billion. The company holds total assets of about $33 billion and a total equity of about six billion. Currently, the company has an employee base of a hundred and five thousand people worldwide.

Dell Computers Company is one of the top suppliers of computers in the world. The company has a wide range of consumers from government to schools and domestic consumers. The company offers a wide range of products such as, network servers, data storage systems, peripherals and software. The company had 96,000 employees in the year 2010 and among them 47 executives. The current year’s revenue is $61,494 million and the total net profit after tax is $2,635 million. The company is listed in the stock market and its value per share is $15.28. The company’s current total assets are $38,599 million.

 

III        On the website http://www.whitehouse.net, the first page has a hacker’s statement. The page has been tampered with by hackers. The website http://www.whitehouse.gov seems to be the official website representing the white house information. However, the first website directs one to the second website when the buttons on the top left hand corner of the screen are activated. The information on both websites is the same except for their first pages. The websites have a blog spot where information on latest issues in the world is posted and viewers are free to comment.

The websites also have a tab that leads to the photos and videos of current events that were covered by the government press. The briefing room is the third tab on the web pages and this leads to speeches, addresses, press briefings and all other information about the President Obama’s addresses. The issues tab is the next tab on the list and on clicking it, it opens up to discussions on major issues facing the world like poverty, ethics. Issues concerning America are also highlighted under the tab. These are issues like, taxes, technology, and the economy, just to name a few.

Personal Experience with Mathematics

Mathematics is the study of amount, formation of various things, phenomena, space and how they change. This subject is the most important and basic in the school curriculum. All other subjects are dependent on Math. In my high school, the administration was very keen on how students perform in Mathematics. The school had a project that helped students to improve on Mathematics and related sciences. There has been an old wife’s tail that boys perform better in this subject than girls. This is not true because all students in a particular school have equal chances of learning and performing excellently.

There are different Mathematics’ courses done in high school. They include pure Mathematics, applied Mathematics and science related subjects like Physics, Chemistry. Pure Mathematics is the basic parts of learning this subject. It includes learning how to operate with the natural numbers or integers. Nothing else is included in this part of the course; it is purely operation on numbers. The other course is applied Mathematics. After the students have learned how to carryout various operations on the natural numbers, then they proceed on how to apply that knowledge. Application of Mathematics is in so many activities that we carry out daily. For example in business, all the calculations done are definitely Mathematics.

Other instances of how Mathematics is applied are in social sciences like Geography and Sociology. These two subjects deal largely with analyzing population or demography. This analysis is mostly presented using figures called statistics. Research has also borrowed a lot from Mathematics. Methodologies like survey and descriptive use statistics to analyze and present the data collected. The outcome of these statistics is what assists the researcher to make a sound conclusion of the study. The basics of Mathematics are also used in a computer to perform tasks. For example, I do calculations when processing data.

Mathematics is an exciting subject, which teaches students and all people how to work with numbers. One just needs to know how to manipulate the figures and get the required outcome. Solving Math problems is interesting because it trains an individual on how to tackle general problems experienced daily. It also makes it easy to do simple calculations in a quick way. It is unimaginable how hard life would be if this subject would not be existing. It has proved to be one of the basics of life. For a person to live comfortably, he or she must learn this subject. That is why it is a compulsory course or subject from elementary up to High school.

Since elementary school, Mathematics has been an interesting subject. This made me to be keen and eventually led to good performance. Initially, I had trouble understanding concepts in this subject. After the helping project was started, I improved and became a performer in Mathematics. Therefore, I performed excellently throughout the years in school. Performing well in Mathematics made me to be excellent in all other subjects, which were related to Mathematics. Perfection in the basics creates good foundation for further learning.

The areas that I found challenging are those in the Applied part of Mathematics. For example, determining the probability of different phenomena. I found it difficult to interpret a situation correctly, when solving the problems. This made me fail to get the correct answer. The part that proved easy and comfortable is learning the basics of pure Mathematics. It is easy and enjoyable to solve the simple calculations. Learning about the nature and characteristics of numbers is also exciting. I agree that Mathematics is a fundamental part of life. Learning Mathematics should not only be viewed as a requirement to a good career but also as a basic need.

Action and Embodiment within Situated Human Interaction

Social action is constructed and understood through talk. Every action must be in agreement with the spoken language and the structure of the surrounding environment. This article tries to analyze the relation between the action, cognition and the details of language. This is done through observing how participants get to carry out different activities by communicating through talking while concentrating on the larger activities of the phenomena surrounding them.

The data is collected from video recordings of young girls playing hopscotch and archeologists classifying color. Human action is created from interactions of different semiotic recourses. In order for a social action to be complete, both the subject who is performing the action and others who are present must be able to discern the shape and character of what is occurring. Otherwise, the intended action cannot be termed as complete.

Munsell chart and the hopscotch grid do not create specific actions; they do however play a role in the hybrid systems, which is crucial to the process through which the actions are accomplished for example how an archeologists perceives and classifies dirt. The lack of these frameworks prevents an action to be fully executed. If there are no hopscotch grid lines, then a body jumping around cannot be termed as playing hopscotch. This is because the participant and the co-participants cannot judge on any irregularities committed. The action is deprived off the visible semiotic resources.

There exists continuity between vernacular and institutional interaction due to the flexibility, which exists through the way in which several kinds of semiotic fields are juxtaposed to each other. In both instances, the actions being performed originated from a set of multiple of semiotic structures and are incorporated to perform the action.

Working with Brain Scans

Neuroscientists gain more knowledge of the brain by the use of digital images. The digital images are obtained through functional magnetic resonance imaging practice, which are viewed from computer screens. This article analyses practical dealings with brain scans in order to appreciate the ability to view images in digital format. The magnetic resonance imaging produces detailed images of anatomical body parts that cannot be naturally viewed by the naked eye. It incorporates the use of radiofrequency and magnetic waves to produce images that are processed by a computer and viewed on a screen.

This is made possible by the existence of varying local environments of water molecules in the anatomical structure of the body. During the scan, the signals are not images but numeric data. The computer processes the signals and converts them into images. This article is concerned with these visual representations of what is not visual. At the laboratories, human visual perception is studied through functional magnetic resonance imaging. The main idea was to localize visual processes in detailed brain regions, and determine how visual stimuli are processed there. The perception of brain images involves the coordination of scientists and digital technology in the field of functional magnetic resonance imaging.

The PI’ gave embodied accounts of shearing, which were transient inscriptions that were transmitted and viewed on the computer screen in order to make the images visible. In addition to this, they indicate to the PD on how to spot the image artifact. These acts of perception discover a border between the virtual and the physical, the digital and the real world together with the abstract and concrete. Digital images are mot relative to a point of view located in space. Research in computer-human interaction points out that products of scientific visualization are a great recourse for the specialists. This is because they enable them to handle abstract data.

Introduction

Egypt has one of the richest architectural histories dating back to the ancient world. As a desert country, she has invented ways of surviving. Her extreme weather is the reason behind her architectural designs and belief system. Egypt revered the gods of nature, who had to be appeased in order for the Egyptians to thrive in the dry land. The country’s architecture is also a reflection of the weather conditions experienced by the country. The specific environmental factors that affect Egypt’s architecture are geographical, geological, social, climatic and religious in nature.

How the Nile and the Sun are Linked to the Development of Egyptian Architecture

In terms of geography, the land of Egypt comprises a narrow strip endowed with alluvial soil along the River Nile (Shaw 420). This fertile area was surrounded by the desert. Egypt’s strategic position to the Red Sea meant that it had control over foreign traders, both those coming into the country, and those going out. The River Nile served as a trade itinerary and facilitated communication. In addition, whenever its waters overflowed, it transformed the sand in the desert into fertile land suitable for cultivation. In this way, it was seen as the lifeline of Egypt. As a result, Egypt started to build cities along its banks. In these cities were built pyramids for the Pharaohs and temples for the priests.

When it comes to geology, Egypt was not well endowed with metals. Therefore, it used limestone, alabaster, syenite, porphyry, sandstone and basalt for construction and beautiful architecture. Household items such as vases and ornaments were also made from these materials. Because of the strength and durability of these materials, Egypt can boast of having its oldest monuments still standing. Limestone was mined from the Mokattam Hills, while sandstone was acquired from the central region of the country (Shaw 370). Syenite was found in Aswan. The methods used to mine, transport and construct architectural work had a huge bearing on the strength of the construction works.

Egypt treated their bricks by sun drying and firing in kilns, resulting in strong houses and palaces. Egypt has seasons of spring and summer. Due to the rare occurrence of phenomena such as rain, fog and storms, the country’s old architecture still stands to date. These elements of weather contribute to faster wearing out of construction works and in their absence, architectural work lasts longer. The constant shining sun penetrated through doors and rooms, negating the necessity for windows. The well-constructed walls protected the houses, and more importantly, provided a good plane for hieroglyphics, an ancient way of Egyptian writing (Shaw 474). The Egyptians were fond of drawing pictures on walls as a form of communication or a part of their rituals.

Egyptians greatly revered religion, and this was manifested in their architectural work. They constructed many beautiful temples to worship Osiri, the man-god. It is believed that this god died and rose again (Faulkner, Carol & James 149). In addition, in the same stride, they too believe that after death, they will come back to life. Therefore, they made for themselves beautiful resting places, called tombs, where they could await their resurrection. Their staunch belief in the after-life is a major reason for construction of long-lasting monuments, particularly the pyramids, where dead bodies were preserved (Shaw 169).

On the social scene, the highly tyrannical government employed a large number of unpaid construction workers, prisoners of war, foreigners and captives to put up the country’s monuments. The story recorded in Exodus 9-11 gives an insight into how oppressive the Egyptian principals were. The Pharaohs forced the Israelites to put up buildings with no pay. The Israelite slaves were expected to mine in the quarries, transport building materials and build. Because of the huge number of slaves and harsh treatment from the Egyptians, the slaves put up many architectural works.

Exploitation of Egypt’s Resources

Egypt has a large stock of natural resources. One of its greatest resources is the River Nile. Being a desert country with very little rainfall, the river sustains all the activities needed for life. It is a source of fish, which is food for the inhabitants. Through its waters, people use boats to move from one place to another. In addition, the river floods annually, spreading silt to the desert sands. As a result, the land becomes conducive for cultivation of crops, another source of food for the inhabitants. Today, Egypt employs the Nile for modern use. The waters are used to produce hydroelectric power to provide energy for households and corporate organizations. The country has a large stock of stones, which it uses in construction. The quarries are worked by drilling holes in a straight line into rocks. Thereafter, the holes are filled with pieces of wood.

The pieces of wood are wetted, and as a result, they expand. After some time, the rocks crack along the holes. Limestone is sourced from quarries in Memphis, sandstone is acquired from Gebel es-Silsila, granite from Aswan and quartzite is found in Gebel el-Ahmar (Shaw 209). In ancient Egypt, copper was the main metal in use. Because it occurs as a mixture of several elements, it had to be heated to extract it. The Egyptians smelted copper ore to obtain pure copper. Here, the ore was placed together with charcoal in a hole in the ground in a windy zone. When the charcoal was lit, the wind fueled the fire to high temperatures necessary for the separation. Later, the bellow system was used to fuel the fire.

Flint is a special type of stone. Found in Egypt in abundant supply, it was used for making sickles, an important tool for harvesting. Furthermore, it was used in making weapons. Steatite is another stone found in the country. It was used mainly for making scarabs, a charm used in religious ceremonies. Flax was an important natural resource. It was cultivated in the fertile regions in the Nile Valley. After its seeds were removed, the plant was soaked in water for a little more than a week. Thereafter, it was crushed into parts that were woven into linen, an important material for clothing.

In present times, Egypt’s main resources are gas and oil. The oilfields of the Mediterranean, just recently discovered, have given the country a place in the oil business. By exporting its oil, mainly to Israel and Turkey, the country earns a lot of revenue, contributing to the growth of its economy. Another natural resource is bees. For the longest time, the bees of Egypt have been reared for the production of honey and beeswax. In ancient Egypt, the wax was used for mummification, and for setting wigs. The honey is used as a medicine, sweetener, and in ancient Egypt, it was used to appease the gods. Lotus honey is the most valued kind of honey in the country (Shaw 156).

Again, the Nile plays an important role in bee keeping in Egypt. Because of the country’s aridity, cultivators developed a new way to enhance the survival of bees. Bees were transported to the Nile’s coastline in beehives. Here, the vegetation provided food for the bees for the production of honey and beeswax. In addition, the Lotus plant imported from India provides good quality pollen for the bees. As a result, Lotus honey, the highest value honey in Egypt, is produced. Egyptians invented the papermaking technique. They made paper from the papyrus plant that grows along the Nile. For a long time, they kept this technique a secret, and ripped huge profits from exporting the paper. In addition, the plant was used for weaving ropes and sails.

Their belief in longevity led them to plan not only for the present life, but for the afterlife as well. Egypt believed in a life after death, and the tombs were a place for one to rest while waiting for the next life. In this respect, tombs were carefully constructed and made as comfortable as possible for the body to rest. For the pharaohs and other members of the elite class, the tombs were decorated with gold, which they would supposedly need in the life to come. Pyramids were also buried in pyramids, the Sphinx for instance. Pyramids were designed to link the dead person’s soul to the gods. In addition, all pyramids in Egypt were constructed on the west of the Nile, the place where the sun sets. This signified the resting of the dead.

However, there is more significance to the pyramids. The inundation of the Nile was a most predictable annual phenomenon. The result was formation of mounds on the land. The Egyptians linked the annual event with creation. According to one of their myths, the first place to be created was a mound of earth, protruding from a universal ocean. The first life to grow on this mound was a lily. The Egyptians linked the lily to Nefertum, the perfect and complete god who brings life to creation (Clark 86). The mound was also seen as a god, and was called Tatjene, translated as “the emerging land”. Thereafter, Egyptians began to construct temples on mounds of earth as a sign of new life.

As the years passed, Egyptians began constructing small blocks in the shape of mounds emerging from the ground. These mounds developed into pyramids as a representation of new life. As mentioned earlier, Egypt experiences two seasons only, that are spring and summer. With the sun shining all year round, Egyptians realized that they do not need windows. Their houses were built with slits in the roof, through which the sun’s rays penetrated. Furthermore, the walls were built with strong material to protect the interior of the houses from the harmful rays of the sun. Because of the predictability and consistency of sunshine, the houses built were permanent structures, suitable for housing throughout they year.

Currently, organizations foresee skills, labor shortages and the impacts of young generations retiring from the work force, and as such organizations are forced to keep the older generation still working. Skills, experience and expertise are retained in the workforce where the number of older generation is greater than the youths. To the woman, retirement brings other approaches of thinking. Apprehension and joy are feelings she usually experiences during this period. The first thing that comes to mind is joy because no person outranking her is giving her anxiety from work. Fear sets in when she starts worrying about how to maintain the lifestyle she was used to. She has various ways and views with which she can use to make money. Gardening is a simple task to keep her active while still keeping herself healthy. Knitting is an excellent relaxation and can be used to make money while still at home. After retiring, she can start a business that she will manage as an alternative of staying idle. This is because a business will provide her with money and keep the mind sharp and healthy. As opposed to the woman who is working at an office, she has the freedom to do what she wishes.

Skills and experience are used to offset a decline in performance by aged workers in order to catch up with the young workers. Mature-aged workers bring more important market intellect in a business thus creating a good market for the company. Initially, companies retired their women in order to bring in younger workers but lately, companies are rethinking their approach on recruitment and training to benefit and provide new challenges for the older women (Potuzak, 2010). This is because they are just as flexible as their young counterparts are and in addition, they are more experienced and highly skilled in their scope of work. I consider that aged women have more comprehension than their young counterparts do hence they posses more skills and intelligence to facilitate the running of the company.

To the man, retiring early has some advantages; he will get the time to explore further the areas that he is not familiar with. He can establish a business from what he had saved in all the years he spent working. The man will get more time to spend with the family and be able to pursue his hobbies, which he had to postpone because of work. Otherwise, he can set up his dream career such as starting a car repair shop or another business. Traditionally, the man retired at an early age but now people are living longer. As a result, the time spent on retirement is also increased. In the society, early retirement is a means of creating job opportunities to the younger individuals. On the other hand, retirement also has a negative aspect to it because people love their work and are not ready to retire. Traditionally, workers retired at a certain age but nowadays people retire at different ages depending on their jobs.

In an organization, mature employees are given the first priorities because they are the backbone of many organizations (Rothwell, 2008). Retiring the older workers would be a big mistake because many of them would go and spend a little time at home then find another organization that they would work for and this would be a loss to the retiring company. Older men are a great tool in the work force because they have all the necessary skills and experience that are in short supply. Strategies are put into place to increase the number of older men who have all the skills that are needed to increase the labor force and potential growth rate. The increased labor force of the older men will have a positive impact on the future growth of the companies. Currently, restructuring the work situation of the older men should be done carefully with sensible modification so that they can perform the job efficiently. In my view, I noticed that early retirement has more reward despite some minor drawbacks. However, I do advocate for retirement because it will create job opportunities to the young age group.

Introduction

United States Labor Laws are a body of laws, administrative rulings and standards, which provide legal guidance to the trade unions, employees, employers and organizations. Historically, the Industrial Revolution initiated the growth of commerce and mass employment; hence, it became necessary to develop a body of laws and standards that governed the work place. The ratification of labor laws was also hugely influenced by the labor movements of the 18th and 19th centuries. Labor laws ensure that all the parties involved in a contract or an agreement are treated equitably.

Discussion

The New Deal Era of the 1930s has largely influenced the present labor laws (Iqbal, 2005). They reformed the labor sector, such that there have been very few major new laws required after it. The Acts that were implemented during this era include; the National industry Recovery Act which aimed at ensuring that industry workers’ wages were worth the amount of work done and the number of hours worked. It also gave employees the right to collective bargaining. The National Labor Relations Act of 1935 was also a product of this era; it gave employees the right to form and join labor unions, engage in collective bargaining and to strike.

This Act is important even to date because it ensures that the employees have a right to be heard in matters pertaining to their employment. It states that any worker has the right to form a union apart from managers and security guards. It also gives employees the right to strike and hold demonstrations in protest of organizational malpractices and injustices. In addition to this, it gives workers the right to join a union. The management should not reprimand employees or threaten them for engaging in union activities. They are prohibited from spying or questioning employees on union activity.

Another law that has remained the same in history and even now is the ‘at-will employment’ standard. It states that both the employer and the employee have a right to end the employment contract at any time without stating the reason. This law’s ambiguity may facilitate discrimination in the work place, where someone is fired due to his or her race, color or disability. Therefore, there have been amendments to this law, which provide that an employer or employee can end the employment relationship at any time and for any reason, as long as it is a legal reason.

There was also a Fair Labor Standards Act of 1938, which states that employees must put in at least two hours of work in a day, and that certain employees working more than 40 hours a week should be given overtime pay. These laws are put in place to ensure that all parties in the employment relationship are accorded their rights and benefit mutually from the relationship. The Fair labor Standards Act was amended in 1950 to state that employees should work a maximum of 40 hours a week (Gold, 1998).

The rights of women in the workplace have also been revised over the years. In 1920, women were given a right to vote through the 19th Constitutional Amendment. To date, this law is viewed as instrumental in the promotion of gender equality in the workplace. The Equal Pay Act of 1963 forbade wage discrimination based on gender, women had a right to earn the same wages as men in the same positions. Women’s rights as an equal sex are therefore recognized more in the workplace now than they were in the earlier years.

The Fair Employment Act of 1941 was the first law to declare discrimination in the work place illegal. Before the implementation of this law, it was usual practice for managers to hire individuals based on their race, gender, age or religion. The law has drastically changed the hiring practices of organizations, such that even today, employers are required to maintain transparency and non-discrimination while hiring and in the course of the organization’s operations. It is still an important labor law. This was followed the 1964 Title VII of  the Civil Rights Act, Title I of the Americans with Disabilities Act of 1990 and the medical leave Act of 1993.

The employee has a right to claim overtime payment for any work done beyond the 40 hours stipulated by this Act. Some jobs will obviously require one to work more than the stipulated 40 hours, it all depends on the type of work, the remuneration and the conditions under which the employee works. This act also declares it illegal to employ a person under the age of 16. It was therefore designed to put an end to child labor. In addition to this, employees of this age are entitled to a certain minimum wage, therefore making it illegal for the employer to under-pay the young employee. The Equal Employment Opportunity Commission (EEOC) was created to implement the anti-discrimination laws (Twomey, 2010).

In 1967, the Age Discrimination in Employment Act was passed; it stipulates that employees should not be discriminated due to their age, especially employees who are 40 years old and over. The younger generation is sometimes favored because they are assumed less expensive in respect to wages and are more energetic. This makes people over 40 less marketable and more likely to remain unemployed in case of job loss. It aims to ensure that employees are hired based on their ability as opposed to their age. Thus helps to solve the problem where older people feel that they are discriminated against in the work place due to their age, and sometimes are not hired for positions they are well qualified for.

The Occupational Safety and Health Act stipulate that the working conditions should be not contain safety and health hazards, all employees should work in a safe environment. To this effect, the Occupational Safety and Health Administration are charged with implementing the Act, through regular workplace inspections. The minimum wage for people working in particularly hazardous jobs is set higher than that of people working in non-hazardous jobs; this is to provide compensation for the occupational risks involved.

The history of labor malpractices began in the early 17th century when African slaves were shipped to America to work as laborers in the English colonies. The conditions were so deplorable that in 1676, there was a massive rebellion of servants and slaves that is referred to as Bacon’s Rebellion. Slavery was later abolished in 1865, through the 13th Amendment to the constitution by the then President Abraham Lincoln. At that time, striking was prohibited, and one could easily lose their job for engaging in a strike.

Before the Industrial Revolution, it was common practice for children to work alongside their parents in their jobs, therefore child labor was not frowned upon. The Industrial Revolution brought with it the emphasis on formal schooling. Therefore, society began to consider it wrong for children to be working instead of going to school with their peers. Child labor persisted, with many children working in factories, mines, hotels and some even running their own small businesses in order to earn a living for themselves and their families. The organizations that used child labor made significant cuts in costs because of using child labor; therefore, they were not willing to adhere to the laws banning child labor. In the worst cases of child labor, children were used in the military and prostituted for money (Robertson, 2000).

It became increasingly important to create well-defined labor laws as employees were severely oppressed by their employers and the regulations of the organizations they worked for. For instance, many employers required the employee’s whole family to work for them for many hours a week, and minimal pay. Employers especially took advantage of vulnerable and minority groups such as immigrants, children and poor people.

The Norris-LaGuardia Act of 1932 aimed to protect the rights of the employees; until then workers were prohibited from striking or protesting. Strikes would be quickly quelled with legal injunction ordered by the courts on behalf of the employer. Failure to obey the court injunction would lead the workers to be arrested for contempt of court. The Act gives employers the right to form unions and prohibits courts from issuing injunctions to suppress strikes or any such activity. The act gives the court the right to issue a Temporary Restraining Order, on condition that it gives parties, the employees and employer, a right to present their case in court and get a fair hearing.

Sexual harassment is now also prohibited by law under Title VII of the Civil Rights Act of 1964, which protects workers from discrimination based on their gender, age and race. The prohibition of sexual harassment is one of the newer labor laws; prior to these protests of sexual harassment were usually ignored and it was quite common for employers to make sexual overtones, remarks and even demands, without facing any consequences. Employees and employers now have a right to report any cases of sexual harassment in the workplace. Society has also played a major part in the amendment and implementation of new laws; there were numerous protests about workplace sexual harassment before it was made illegal. Thereby, acceptance or rejection of certain behavior and actions in the workplace is reflected in the labor laws (Atleson, 1983).

Conclusion

This paper therefore illustrates that current labor laws largely build on the labor laws that have been formulated and implemented over the last 100 years. For instance, the minimum wage stipulated in the Fair Labor Standards act has over the years been appraised and amended because the cost of living has gone up die to factors such as increased inflation. Therefore, the minimum wage must also be increased in order to meet the current financial demands. As society becomes more aware of their rights and the injustices in the workplace, it calls for the revision of current laws and the formulation of new laws and acts in some cases. Therefore, the creation and enhancement of labor laws is a perpetual process.

The Fiedler contingency model of leadership was developed by Fred Edward Fiedler. It states that leadership is determined by an individual and the environment or people he or she intends to lead. In this case, the word contingency has been derived from the name contingent, which means people with a certain relation. They could be workmates under the same supervision or employees in the same organization. Leadership is defined as the ability to influence people to act or do what is expected of them. For a leader to be efficient, he or she must have strong character in order to set the pace for his or her subordinates.

This particular leadership theory is applicable depending on the situation at hand. The factors to consider in determining the situation include the relationship between the leader and his or her subordinates; the nature of duties to be done; and how powerful the leader is. If the relationship between the leader and followers is strong and they trust their leader, then he or she will influence them easily. Knowledge of the tasks to be done is important because it determines how the situation will be viewed. If the duties are unclear then the situation is not favorable. The stronger the power a leader has the better. This is because it will be easier to implement what is expected.

Fiedler discovered that a leader who is focused on carrying out tasks or an authoritative leader fits best in areas that are not favoring. Relationship-oriented leadership fits well in areas that are favoring or fairly favoring. For this theory to be implemented, Fiedler says that there are certain steps that should be followed. The first step is to determine the leadership style in use. To do this, one has to evaluate his or her relationship with a former least-preferred workmate. This step will enable a leader to identify whether he or she is using the employee-oriented style of leadership or the task-oriented approach.

The next step is to identify the situation a leader is handling. This is determined by factors such as how the relationship is between employees and the leader. If it is healthy and strong then the situation is favoring. If it is poor then the situation is not favoring. The task factor is vital too. If the leader has clear knowledge of tasks and there is a structure, it is concluded that the situation is favoring. In case there is no structure of tasks and they are unclear to the leader, the situation is not favoring. The level of power a leader has is an important determinant as well. The more powerful the leader is, the more the situation gets favorable.

The final step is concluding which leadership style suits best. For instance, an employee has been appointed a team leader. Since he or she has never led before, his or her followers do not have trust in the leadership. Such kind of a leader would utilize employee-oriented leadership, with the aim of instilling trust in the subordinates. A leader may have won his or her followers trust and has power. Unfortunately, the kind of task is unstructured so it is vague. Such kind of a leader is advised to adopt a task-oriented style.

Fiedler’s theory of leadership is beneficial to managers or leaders because it assists them to select a favorable leadership style. This model is also helpful to the leaders because they can evaluate themselves and determine what kind of leaders they are. However, it has several shortcomings. It has been noted that the model is rigid, especially to the leaders. They have not been given room for flexibility on how they change. Fiedler asserts that for effective leadership, the leader should change according to the situation.

Another limitation acknowledged by Fiedler is that this theory can only be implemented on a group with common and close supervision. It cannot be applied on some groups like a bowling team. This is because such members bring together their yields to get a common achievement. This model does not cater for intermediate results. For example, the situation can be described to be either favorable or not favorable. There are no solutions if a situation would be averagely favorable.
