Others argue that with the ubiquitousness of technology has made it easier to cheat now than in the past. Yet, others advance the perspective that the “differential association” that occurs within the corporate culture is the real culprit for white-collar and professional criminal behavior.

Is white-collar criminal behavior merely a reflection of all that is wrong with our society, that is – envy, greed, high expectations, strain for success, unequal distribution of wealth…. as we have studied regarding mainstream theories in earlier chapters, or does white-collar criminal behavior actually spring from unique factors, as posited by Sutherland, and other white-collar theorists who challenged mainstream criminological theories? What factors are they?

When criminological theory seems to be unable to find “what works!” in deterring crime and criminal behavior – it went right back to where is all started – the Classical School. Beginning in the 1980’s, the “tough on crime” policies sprang from what the Classical School and Positivist posited – crime is the result of individual actors’ exercising rational choice or as the result of organic anomalies or psychological defects. Thus, the short answer to the “crime wave” perception was: incapacitation. Consequently, over the past four decades, America experienced an “ imprisonment binge” — resulting in the highest rate of incarceration in the world.

Your essay should outline the HBM and draw on the evidence from the journal article you identified for the journal article activity. 2. 30 points The Legal Background Explain the law as it may relate to this case. This will include cases, constitutional provisions, and statutes, and other materials as necessary to give your reader a good grasp of the legal landscape onto which this case steps.

3. 60 points Argumentative Positions A brief is a systematic legal argument made up of one or more (usually many) argumentative positions. In this section provide two collections of argumentative positions – one collection for each party. These are building blocks from which a brief might be made. They can be various and even contrary but they are clearly meant to be the persuasive building blocks of a constitutional argument in favor of each party to this suit.

4. 20 points Questions for the Future In addition to the outcomes every decision of the Supreme Court has implications for the two parties to the suit, there are broader implications for the society in the future. Explore those broader implications through a series of probing questions about the disposition of this case one way or the other. The questions should demonstrate thought and be directive. Avoid simplistic or over generalized questions.

5. 30 points Annotated List of Source Materials. Provide a list of good resources to consult in deciding this case – some cases, some secondary treatments from books and articles. For each entry, explain what utility that source has – demonstrate that you’ve actually consulted the source, and not just found it in a list somewhere. A source, BTW is not a webpage. A source is an actual TEXT, which might be found on a webpage—the difference between pointing to a book and pointing to a library shelf. I want the book and not the shelf. Wikipedia may be a great place to start a search but it itself is not an appropriate source for academic work.

To prepare for this Discussion:
• Review Chapter 3 in the course text, Administrative Law and Politics: Cases and Comments. Pay close attention to the historical background of the Munn v. Illinois and Lochner v. New York cases. Think about the historical implications of these cases on the current process of judicial review.
• Review the article, “Does Legal Doctrine Matter? Unpacking Law and Policy Preferences on the U.S. Supreme Court.” Reflect on how the judicial branch impacts policy decisions and how their positions influence future court rulings.
• Review the article, “To Preserve Meaningful Judicial Review.” Consider the role of the judicial branch in the creation and execution of law and public policy.
• Review the assigned pages in Chapter 10 of the course text, Administrative Law and Politics: Cases and Comments. Think about how the courts resolve disputes and how this impacts the creation and execution of law and public policy.
• Review the handout, “Fundamentals of Law and Public Policy – Resources” (Provided in the Introduction area). Using the Walden Library, select a research article that illustrates the importance of the judicial branch (e.g. – the courts) in the creation and execution of law and public policy.
