Officer Jones asked the neighborhood’s regular trash collector to put the content of the defendant’s garbage that was left on the curb in plastic bags and to turn over the bags to him at the end of the day. The officer searched through the garbage and found items indicative of narcotics use. The officer then recited the information that was obtained from the trash in an affidavit in support of a warrant to search the defendant’s home. The officer encountered the defendant at the house later that day upon execution of the warrant. The officer found quantities of cocaine and marijuana during the search and arrested the defendant on felony narcotics charges.

Case Study 3: Confessions and Admissions after a Request for a Lawyer

A suspect is apprehended in a large-chain grocery store by the security guard. The suspect is placed in handcuffs and taken to the manager’s office. The police are called and advised of the situation. Officer Jones arrives at the store approximately 12 minutes later. Officer Jones takes a statement from the security guard and views the in-store camera film of the shop lifting incident. Officer Jones places the suspect under arrest, reads the suspect the Miranda warnings, and asks the suspect if he would like to make a statement. The suspect replies, “No, I would like a lawyer”. Hobbes ultimate goal was to end civil war and bloodshed by a social contract between the government and the people where he people submit themselves to a political authority thereby giving up their liberty. His argument is based on his assessment of what life would be like without a government which he calls the state of nature. In this state of nature, all of the citizens believe that they have a right to everything. This state ultimately produces endless conflict since all of the citizens would be fighting for limited resources and power. In the logic of Hobbes, the state of nature is a state of war. In order for citizens to have peace and avoid war, they would have to give up their liberty, or the right to all things, to a sovereign authority. A sovereign authority is one with absolute authority in all things. A state such as this is basically a totalitarian state. This state, according to Hobbes, would be based on the golden rule or the laws of nature: do unto others as you would have them do unto you. I understand the reasoning behind the political theory of Hobbes, but his theory does nothing to lift a person out of what he described as a state of nature. If everyone believes that they have a right to everything then how would an absolute authority not believe that they had a right to everything? What parties would be more likely to follow the golden rule in practice: Two people with equal power or one person with no power and one absolute power?

Is Iran an Islamic republic, a theocracy, or something else?

According to Kesselman, Krieger and Joseph, “Iran is a mixture of theocracy and democracy”. (Kesselman, Krieger and Joseph, 2013) My understanding after the assigned reading is that Iran is technically more a theocracy then a democracy and the alleged democracy in place is not a democracy at all. The only democratic-like thing is the election of the president and clerics but they may also be skewed due to the control over the media. The president is elected by the people but the high religious figures are the ones with the real power. They control the functions of the government most of the time.

Another factor that comes into play when trying to understand the political system of Iran is the type of “democracy” that it uses. In a true democracy all citizens have equal rights. But, in Iran where it is ruled and inhabited by a certain sect of the Islam religion, Shi’ism, only the Shia are looked at as equals. Christians, Jews (the very small percentages) and even Sunni Muslims are looked at differently. According to Kesselman, Krieger and Joseph, the amount of Muslims in Iran that are Shia account for roughly 90% of the population. The remaining 10% probably have no voice at all. (Kesselman, Krieger and Joseph, 2013)

Because the Islamic Republic of Iran is a just that, an Islamic Republic, I am not sure that it is capable of true democracy. Two things in the Kesselman text stood out to me. First, when the fact that Khomeini said that Islam and democracy are compatible. I will argue that they are not since women and people of different religions are not viewed as equal. Another thing that surprised me at first but does not at all now is how Khomeini allegedly sent funds to fundamentalist groups around the world. What is more interesting is that Iran was initially helping with the Global War on Terrorism until Iraq came into the picture. (Kesselman, Krieger and Joseph, 2013)

The legal system also is that of a non-democratic country. Sharia law is in effect and this can cause or lead to oppression for the minorities. The people who came out and contest elections or speak poorly about leadership are jailed.
