Identify and discuss the rights of victims or defendants that were not exercised during the criminal justice process in this case.

While patrolling during his shift, a Centervale police officer, Detective Johnson, saw two men standing on a street corner. Johnson observed the two proceed alternately back and forth between the street ahead and the corner, pausing and returning to conference. Detective Johnson found this strange as the Love’s Jeweler shop was down the street. The two men repeated this ritual alternately three to four times, which appeared as if they were looking out for someone or were about to steal something. Detective Johnson saw a third man approach and handing something to one of the two men, which he stuffed into his pocket.

Detective Johnson approached the three men and identified himself as a policeman. He saw the man that stuffed the item in his pocket place his hand in his pocket again. Detective Johnson kept his eyes on the man and asked their names. Before they could answer, the detective turned the man around, patted down his outside clothing, and felt a hard object. The man objected saying, “Hey man, you can’t do that. I have rights. I want my lawyer.” Detective Johnson sneered, “Oh! you’ll get your lawyer.” Upon feeling the object, the officer removed his gun and asked the three to raise their hands and place them on the wall. The officer patted each man down and found a gun in the pocket of one man. He removed the jacket of another man and found a diamond ring in the inside pocket. The third man did not have anything in his pockets.

The three were taken to the police station and charged with grand theft and burglary. One of the men was also charged for carrying a concealed weapon. Detective Johnson ran the information concerning the gun and found that it matched the gun related to an aggravated battery and rape case from a year ago. The detective questioned Danny, the man who had the gun. At first, Danny did not want to say anything, but the detective continued questioning him. After three hours, Danny confessed to the aggravated battery and rape case. He denied being involved in the grand theft and burglary.

Danny had a first appearance in the court within three days, whereupon he is appointed an attorney but denied bail. Danny does not see his attorney until the next court appearance. The attorney asks what he wants to do and Danny said, “I want to fight it man.” The attorney tells Danny, “That’s not going to work; the DA is offering you a good deal if you plea.” Over the objection of the victim in the court, the DA offers Danny probation if he testifies against the other two in the burglary case. The DA wants the other two to be sentenced to ten years in that case. While shaking his head, Danny pleads guilty above the cries of the victim. The DA asks the judge to hold off on sentencing until after he testifies in the other trial.

After Danny testifies against the other two defendants and they are sentenced to ten years, Danny goes back to the court. The judge, not agreeing with the deal, decides to sentence Danny also to ten years. Leaving the courtroom, Danny asks his attorney to appeal the case. His attorney states, “Man, you don’t even have the right.”

Considering what you learned about the criminal justice process, discuss the roles of the detective, the defendants, the attorneys, and the judge. What did each do right or wrong in this case? What rights did the victim or the defendants have that were not exercised in this case? Explain your opinion about what should have happened by using the information from the text or outside sources.

Demonstrate how the principles of the theory support a certain position on that question.

Please read these assignment instructions before writing your paper, and re-read them often during and after the writing process to make sure that you are fulfilling all of the instructions. Please also utilize the assignment guidance and the outlined model provided.

Overview

The following short essay assignment is designed to help prepare you for an important part of the Final Paper. In this essay, you will do the following:

  • Choose either the same ethical question you formulated and introduced in the Week One Assignment, or a different one based off the list of acceptable topics.
  • Choose either utilitarian or deontological ethical theory to apply to the ethical question.
  • Explain the core principles of that theory.
  • Demonstrate how the principles of the theory support a certain position on that question.
  • Articulate a relevant objection to that position.

Instructions

Write a five-paragraph essay that conforms to the requirements below. The paper must be at least 1,000 words in length (excluding title and reference pages) and formatted according to APA style as outlined in the Ashford Writing Center. The paragraphs of your essay should conform to the following guidelines:

    • Introduction

The introduction should clearly state the ethical question under consideration, and define the essential issues. You may build upon the question and introduction you provided in the Week One Assignment; or you may choose a different question, but it must be based off the list of acceptable topics. Your introduction should include a brief remark about the kind of theory you will be using to approach this question. The last sentence of the introduction should briefly summarize the or position on the issue you think is best supported by this theory and succinctly state what the objection will be. Bear in mind that your essay will not be concerned with your own position on this issue, but what someone reasoning along the lines of the chosen theory would conclude; this may or may not be the position you took in the Week One Assignment.

    • Body Paragraphs

Each paragraph in the body should start with a topic sentence that clearly identifies the main idea of the paragraph.

        • Theory explanation

Explain the core principles or features of the deontological or utilitarian theory and the general account of moral reasoning it provides.

You must quote from at least one required resource other than your textbook that defends or represents that theory. Refer to the list of acceptable resources.

        • Application

Demonstrate how the principles or features of the deontological or utilitarian theory apply to the question under consideration and identify the specific conclusion that results from applying the reasoning characteristic of that kind of approach.

Your application should clearly show how the conclusion follows from the main principles and features of the theory as addressed in the previous paragraph. Please see the associated guidance for help in fulfilling this requirement.

      • Objection

Raise a relevant objection to the argument expressed in your application. An objection articulates a plausible reason why someone might find the argument problematic. This can be a false or unsupported claim or assumption, fallacious reasoning, a deep concern about what the conclusion involves, a demonstration of how the argument supports other conclusions that are unacceptable, etc. You should aim to explain this objection as objectively as possible, (i.e., in a way that would be acceptable to someone who disagrees with the argument from the previous paragraph).

Note that this does not necessarily mean that the objection succeeds, or that the conclusion the theory supports is wrong. It may be an obstacle that any adequate defense of the conclusion would have to overcome, and it may be the case that the theory has the resources to overcome that obstacle. Your task here is simply to raise the objection or present the “obstacle.”

  • Conclusion

The conclusion should very briefly summarize the main points of your essay.

Resource Requirements

  • You must use at least two resources to support your claims.
  • At least one of the resources should be one of the Required or Recommended Resources that represent the theory you have chosen, and must be drawn from the list of acceptable resources available in your online classroom.
  • The other source should pertain to the particular issue you are writing about and should be drawn from the required or recommended readings in the course, or be a scholarly source found in the Ashford Unversity Library.
  • You are encouraged to use additional resources, so long as at least two conform to the requirements above.
  • The textbook does not count toward satisfying the resources requirement.
  • To count toward satisfying the requirement, resources must be cited within the body of your paper and on the reference page and formatted according to APA style as outlined in the Ashford Writing Center.
  • If you are unsure about whether a resource fulfills the requirement, or need assistance in finding resources, please contact your instructor.

Due Week 4 and worth 100 points

Choose one (1) of the three (3) reading selections from the list of topic choices below. The focus is on brief but important primary source material written by major authors. Read the selections  as identified with each topic below. Write a three to four (3-4) paragraph essay (250 words minimum) which analyzes the “surprise ending” of the reading selection.

Topic Choices

  • Reading selection from Descartes’ Discourse on the Method (Part IV). Descartes begins with a  proof of one basic conclusion and ends with a proof of something much grander. Remember to focus on the surprise and point of realization, not the details of the philosophical argument. Read Part IV of the Discourse on the Method located at http://www.earlymoderntexts.com/assets/pdfs/descartes1637.pdf (then scroll down to Part 4, pp. 14-18). This is only four or five (4 or 5) pages of the larger work.
  • Reading selection of Swift’s A Modest Proposal. It is essential to recognize the genre of this work, as discussed in our class text, which you should consult and cite. Swift promotes a radical solution, but subtle options are mentioned. You are looking for surprise and a point of realization. Read and focus on A Modest Proposal located at http://www.victorianweb.org/previctorian/swift/modest.html.
  • Two (2) reading selections from Voltaire’s Candide. Consider how these readings start and end in terms of the action and the beliefs. You are looking for surprise and a point of realization. These selections can be found on pp. 840-841 in the textbook. In addition, consult the class text at pp. 824-825.

For the reading selection you choose:

  1. Clearly state in your own words the “surprise ending” in the reading you selected. Clearly identify the point in the reading when you realized that there were elements in the reading that surprised you. Not all of the surprises come at the end.
  2. Evaluate how successful the author was in convincing you to accept the validity of the “surprise ending” that was different from what you expected.

Your assignment must follow these formatting requirements:

  • Be typed, double spaced, using Times New Roman font (size 12), with one-inch margins on all sides; citations and references must follow APA Style format. Check with your professor for any additional instructions. (Note: Students can find APA style materials located in the Additional Resources section of their Student Center within their course shell for reference)
  • Include a cover page containing the title of the assignment, the student’s name, the professor’s name, the course title, and the date. The cover page and the reference page are not included in the required assignment page length.
  • Use the source(s) identified above for the topic you choose, focusing on the main primary source of that author. You may use additional sources also if they are of good academic quality for college papers (Wikipedia and similar websites do not qualify). Use proper APA style in-text citing and also a matching APA style References list at the end.

The specific course learning outcomes associated with this assignment are:

  • Explain how key social, cultural, and artistic contributions contribute to historical changes.
  • Explain the importance of situating a society’s cultural and artistic expressions within a historical context.
  • Examine the influences of intellectual, religious, political, and socio-economic forces on social, cultural, and artistic expressions.
  • Identify major historical developments in world cultures from the Renaissance to the contemporary period.
  • Use technology and information resources to research issues in the study of world cultures.
