Crime solicitation refers to the criminal offense, which is conducted when an individual informs, encourages or triggers the other individual to commit a crime or join this person in committing a crime (Pinnizzotto, 2012). In relation to the common law, solicitation is considered a misdemeanor. This assumption is applied to whether the crime committed is a felony or not. Conspiracy is often an agreement between two groups or many to commit an offence. Several provisions must always be met for a defendant to commit a conspiracy crime. On these provisions include the men’s rea, which comprise two prongs. In the first prong, the defendant is usually believed to have intentions to commit a crime (Aureliusz, 2011). On the other hand, the second prong takes it that the defendant must have had the interest of accomplishing the goal of the conspiracy crime at the moment the defendant joined the agreement. In addition, this freedom should be extended to the admissibility of relevant proofs during hearing.

Currently, defendants who are tried due to battery or assault may claim that their actions were attempted to prevent the victims from stealing or to damage their property. However, recent policies limit the use of force in the protection of property. The law demands that individuals should not use excessive force when they are defending their properties from intruders or other strangers (Aureliusz, 2011). This law is applied even when the act of interference is considered unlawful. Furthermore, people are not permitted to apply excessive force even in the absence of alternatives means of property protection.
