BACKGROUND
In this course we have been generally exploring the the relationship between law and social change as it is reflected in evolving judicial, political and social approaches to the issue of same-sex marriage in Canada. This assignment tests your ability to summarize and analyze literature that deals with a sub-topic of this issue.

ASSIGNMENT – TASK
Provide a summary and analysis of “Patrolling the Borders of Sexual Orientation: Bisexual Refugee Claims in Canada” by Sean Rehaag (available in the Assignment 2 Folder on cuLearn) and discuss how the article fits in the broader literature concerning the movement to legalize same-sex marriage in Canada.

Your summary and analysis should include all FIVE parts below and address ALL questions asked. Use the major headings of the parts below in your essay.

ASSIGNMENT – REQUIRED COMPONENTS

Part I: Introduction (3 marks)

Provide an introduction to your essay that includes the following information:
• Introduce the article you will be analyzing in the assignment. Be sure to provide the name of the author, the status of the author (e.g. whether the author was a professor, a student or a practicing lawyer when the article was written), the name of the article, and the year the article was published.
• Provide a ‘road-map’ of the topics your essay will address.
• Note that your first footnote should provide a correct citation for the article.

Part II: The Author’s Research Project (5 marks)

Describe the framework for the author’s research project by providing the information to answer the following questions:
• What central research question does the author deal with in the article?
• What theory or theoretical perspectives did the author apply in the article? Briefly describe the theoretical approach.
• What research methods did the author use to gather information for the article? (i.e., what types of evidence did the author rely upon; how did the author obtain that evidence?)
• How did the author structure the article (i.e. what major topics did the article cover)?

Part III: Summary and Analysis of the Article (10 marks)

Provide an analysis of the article. Be sure to answer each of the following questions:
• What was the authors’ thesis? (2 marks)
• Identify three reasons put forth by the author to explain the low grant rates for bisexual refugees. Briefly explain the author’s arguments concerning the impact of each rationale (why are some explanations more valid than others and in what cases). Provide examples from the text to support your answer. (3 marks)
• What arguments and evidence does the author present to support the claim concerning the “epistemic contract of bisexual erasure” in Canadian sexual-minority refugee jurisprudence? Explain how this point relates to the issue of how refugee claims by members of sexual minorities alleging a fear of persecution on account of bisexuality are less successful. (1 mark)
• What solutions does the author offer? What are the three categories of persecution that the author proposes should be considered more by sexual-minority refugee claimants and how can each of these help bisexual refugee claimants? (2 marks)
• How sustainable are the author’s arguments concerning why bisexual refugee claimants are less successful and the claims of an epistemic contract of bisexual erasure” in Canadian sexual-minority refugee jurisprudence? (Does the author provide sufficient evidence to support the claims? Does the authors’ conclusion accurately reflect what the evidence suggests? Are possible contrary interpretations addressed sufficiently?) Explain your answer. (2 marks)

Part IV: Situating the Article in the Broader Literature (12 marks)

A. Approach: Provide an analysis of how ” Patrolling the Borders of Sexual Orientation: Bisexual Refugee Claims in Canada” by Sean Rehaag fits into the broader literature concerning the legalization of same-sex marriage that we have reviewed in this course by addressing the following questions:

a) How is the approach adopted and argument advanced by Sean Rehaag similar to or different than the approach adopted and argument advanced by Nicholas Bala in his article, “Controversy over Couples in Canada: The Evolution of Marriage and Other Adult Interdependent Relationships”? (Include reference to the research question, theory, and method in the article.) (5 marks)
b) How is the approach adopted and argument advanced by Sean Rehaag similar to or different than the approach adopted and argument advanced by Claire Young and Susan Boyd in their article, “Losing the Feminist Voice? Debates on the Legal Recognition of Same Sex Partnerships in Canada”? (Include reference to the research question, theory, and method in the article.) (5 marks)

B. Opinion: Based on your reading of the Rehaag, Bala and Boyd and Young articles to what extent do you agree or disagree with the following statement (two reasons with supporting arguments and evidence): (2 Marks)

• The struggles of bisexual refugee claimants have little to do with the “heterosexism” and familial ideology embraced by the same sex movement.

Instructions: Use specific reasons and examples to support your answer. This portion should be made up of a small introduction line to introduce the topic and give your clear answer to the question (I fully agree or disagree with the claim). Second part, main reason 1 and why you agree or disagree, give examples and supporting details; main reason 2 and why you agree or disagree and give examples and supporting details, conclude by restating your opinion.

Part V: Conclusion (2 marks)

Provide a brief conclusion that summarizes the main points you have raised in your essay.

Bibliography and Citation (4 marks)

Provide a bibliography (include as a minimum, references to the secondary sources identified in the assignment and any cases you refer to in your answer) using correct form following the Canadian Guide to Uniform Legal Citation (McGill Guide), 8th Edition.

In addition to your bibliography, ensure that you provide proper footnotes or endnotes using correct form following the Canadian Guide to Uniform Legal Citation (McGill Guide), 8th Edition.

Spelling, Grammar, Writing Style and Structure of Essay (4 Marks)
Pay attention to your writing. Use section headings that correspond to each major part of the assignment (e.g. Part I – Introduction). Make sure that you use complete sentences and have a clear and logical structure. Review, revise and edit your essay to ensure it is free from typographical and grammar mistakes.

ADDITIONAL REQUIREMENTS AND INSTRUCTIONS

Spacing and Font: Use double-spacing except for block quotes. Font should be Arial 11 pt or Times New Roman 12 pt with regular page margins. Insert page numbers.

File Format Submit your file in MS Word. Please convert WordPerfect files into MS Word. Do not submit in Mac Pages or as a PDF. This creates conversion and compatibility issues.

Length:
• Your Summary and Analysis should be no more than 3000 words long (approximately 12 pages). Footnotes or endnotes are not included in the word count. We will give a ‘grace’ allocation of a further 100 words for headings and cover page. You will lose marks if you go over the word limit (pro-rated at the rate of 1 mark/300 words; so you will lose 0.5 marks if you go over 150 words and 1.5 marks if you go over by 450 words and so forth.
• This word limit may seem long when you begin and short when you get into the assignment, but your ability to discern the most relevant information and to focus your analysis is one of the skills being assessed in this Assignment. Pay attention to the mark allocations as a further guide to allocate your word limit.
• Summarize rather than directly quoting from the article except where you wish to comment on particular phrasing. You must provide correct citations for direct quotations from the article and after lengthy summaries of parts of the article. However you do not have to provide a citation for every individual fact or line you summarize from the article.
